What is title insurance, and why do I need it?

Title insurance is an insurance policy that protects your real estate investment against loss that could result from defects in the title of the property you are purchasing. Examples of such defects include unpaid liens, instances of fraud during a sale, or improperly executed documents from a previous title transfer.

The premium is paid completely paid at closing, and the title insurance policy is valid as long as you or your heirs own the property. Unlike most types of insurance that protect policyholders from future events, title insurance protects you against defects that could already exist in the title to a property.

What does title insurance cover?

Title insurance protects real estate owners against any property loss or damage they might experience because of liens, encumbrances or defects in the title to the property. How does title insurance differ from other insurance?

Title insurance protects a policyholder against challenges to rightful ownership of their property, challenges that arise from circumstances of past ownerships. The premium is paid only once at closing and is valid as long as you or your heirs own the property.

What does a home warranty cover?

Home warranties cover a home’s appliances and major systems, such as air conditioning, heating, electrical and plumbing. Coverage offered varies by package and state. Home warranties provide peace of mind to buyers and add value to their property for sellers.  However, they do not insurance against defects in title.

Aren’t adjudicated and land bank properties traditionally excluded from the title insurance market?
